Abstract
This paper considers the problem of law enforcement practice in addressing issues of withdrawal courts imposing sanctions on the collateral for mortgage loans. Analyzed the most frequent questions that put before the courts. Identified and justified the need for changes in legislation and the establishment of pre-trial procedures for dispute settlement.
