Abstract
This article is devoted to the review of regulations and law enforcement practices of surrender, as circumstances mitigating punishment. The conducted research gives reason to state that the surrender always softens punishment, in case of acceptance by the courts and other competent authorities. Courts expanded the scope of its recognition rather than fixed in the law.
Recognition of surrender has great public importance.
