THE ELEMENT OF SELF-DEFENSE IN THE GUARANTEE OF THE INDEPENDENCE OF JUDGES

Abstract
The article describes the principle of the independence of judges from the point of view of participants in the process of self-defense from the court does not meet the requirements of independence, objectivity and impartiality. The study suggests that the institution of recusal is a peculiar way of public scrutiny of judicial independence. The relevance of the topic chosen is evidenced by the fact that an independent judiciary is the main guarantor of the rights, freedoms and legitimate interests of individuals and legal entities necessary for the establishment of the rule of law.
