Abstract
The article analyzes the problems of protection of the rights of subjects, engaged in the operational-search activity. Specific examples of judicial practice, the authors show the shortcomings of the existing mechanism for the release of employees, engaged in the operational-search activities, from liability in case of damage to their legitimate interests. The authors suggest the basis of existing international experience to fix an appropriate basis for exemption from criminal liability in the Criminal Code.
